Travellers’ rights: why are Australian consumers grounded while other jurisdictions reach new heights?

We are proud that our Victoria Roy will be presenting this travel law session at the Australian Lawyers Alliance NSW State Conference at the Hilton in Sydney on Friday.

Victoria will examine pro-consumer legislation that travellers benefit from in jurisdictions such as the UK and European Union and ask, why is Australia so far behind.

From flight delay compensation, to liability of service providers such as hoteliers and shore excursion operators, to the fairness of exclusive jurisdiction clauses, Australian consumers have far fewer rights than their travelling counterparts. It is time for change.

Victoria will also look at the recent Court of Justice of the European Union decision BT v Laudamotion GmbH which found that psychiatric injuries fall under ‘bodily injury’ under the Montreal Convention, and call for this approach to be adopted in Australia.

This session is a must for anyone practising travel law, consumer law or simply likes to travel themself.

If you've had an accident on a cruise ship or in a foreign country and decide to make an injury claim, it's harder to pop back to take photos of where it happened than if it happened in your local shopping centre.

If possible, its best to take photos at the time. However, if you're too badly injured or shaken to think about this after an accident, here are some tips for things to do at home:

1. Find the area on Google Maps Street View

2. Find photos of the ship or hotel on the travel company's official website or review websites like TripAdvisor

3. Find a tour of the ship / resort video on YouTube and take a screenshot of the area

4. Find a Deck Plan of the ship in the brochure or online to mark where your accident happened

This is a question that we get asked a lot in our free no obligation chats with new clients!

The answer is that each case is different. In our experience the main three factors that affect how long a case takes are:

1. The nature of your injuries and your treatment plan (because we generally need to wait for your injuries to settle down before we get medical assessments done on you).

2. Where the defendant travel company is based, as it is usually quicker dealing with companies based in Australia or who use Australian lawyers.

3. How quickly you get things back to us! While we aim to make the process as stress free as possible, we will need your instructions to do things and for you to provide us with certain documents. The quicker you can do that, the quicker the process!

Whilst each case is different, to give you an idea we aim to resolve cases within 18 months to 2 years of you instructing us.
