Important Australian Migration Update

Home Affairs Minister Tony Burke has announced significant changes to Australia’s migration settings, and understandably, many international students, graduates and families are waiting for clarity on what this means for them.

Two key announcements to be aware of:

🎓 Student & Graduate Visa Dependants
The Government has announced plans to restrict secondary applicants on most Student and Graduate visas.

Importantly, exceptions will apply, including for certain cohorts and courses, and further details around how the changes will operate are still to come.

✈️ Visitor Visas – No Further Stay
The Government has also announced that future Visitor visas will carry a No Further Stay condition, restricting the ability to transition to most other visas while in Australia.

These announcements do not mean every change takes effect immediately today. The Government has stated that the reforms will be progressively implemented, with further details still to be released.

If you are currently studying in Australia, planning to bring your family, considering a Visitor visa, or planning your next visa pathway, please don’t panic or make decisions based on headlines alone.

Returning to Australia on a Student visa? ✈️🇦🇺

This post is a reminder that being prepared and understanding your own study history can help you travel with greater clarity.

During immigration clearance, officers may consider your broader circumstances and not only whether you currently hold a valid visa and CoE.

This may include:

• Current and previous enrolments
• Cancelled CoEs
• Attendance and academic progress
• Course changes or study gaps
• Your current study circumstances

Before travelling, make sure you understand your study journey and can provide relevant supporting information where required.

If you have experienced course changes, CoE cancellations, study gaps or other complications, consider seeking personalised advice before travelling.

➡ Gentle reminder: If you are currently in Australia on a Temporary Graduate (485) visa, you can no longer apply for a Student Visa while remaining onshore.

What this means for you:
🔹 No More Onshore Switching: If your 485 is ending you must depart and apply for your new student visa from offshore.
🔹 No Bridging Visas: Unlike before, you cannot stay in Australia on a bridging visa while waiting for an offshore student visa decision.
🔹 Stricter Scrutiny: Re-applying multiple times for a student visa to prolong your stay is now a major red flag for Home Affairs.

This condition requires you to:
1️⃣ Remain enrolled in a CRICOS-registered course.
2️⃣ Maintain satisfactory course progress.
3️⃣ Maintain satisfactory attendance.

If you fall behind or stop going to class, your provider is legally required to report you. And this can lead to visa cancellation! 🚫
