If you are in a situation where you are being refused access to your grandchild, your first point of call should be to seek legal advice. Going to Court should be a last option.

Unfortunately, grandparents do not have an automatic right to have a relationship with their grandchild, however if they can show they have an integral role in the care, welfare and development of their grandchild they can apply to the Court for a parenting order.

A parenting order can allow for time and communication with a child, and it will be up to the Court to decide what the order will stipulate based on what is in the child’s best interest.

Before you move forward it is in your best interest to try to come to an agreement with the parents about how and when you can have contact with your grandchild.

Financial Duty of Disclosure

All parties involved in a family law financial matter are required to provide each other with full and frank disclosure.

It requires disclosing all sources of earnings, interest, income, property and other financial resources along with any information about any property disposal (whether by sale, transfer, or gift) that was made in the year immediately before the separation of the parties or since the final separation and that may affect, defeat or deplete a claim.

If a party fails to disclosure, the Court may refuse the use of that information later in your case, order costs against you, fine you or imprisonment.

3. Speak politely – Changeover can already be a stressful time, stay calm and keep it friendly.
