The structure of the Australian family has changed, but many estate plans are stuck in the past.

Our Principal Solicitor, Jennifer Williamson, is urging families to look closely at their documentation. She warns that failing to account for past relationships and new family dynamics can lead to fractured families and estates consumed by legal costs.

"I am seeing a dramatic rise in contested estates because people are not updating their Wills," Williamson said.

"When a Will does not reflect a new partner, new children, changed financial circumstances or altered family relationships, it creates uncertainty, resentment and often litigation."
