Travel Restrictions – Update

For Clients Who Are Relocating Across Regions

Our institute has been advised by the Commissioner for Consumer Protection that the Police Superintendent responsible for the regional travel restrictions initiative has granted a general exemption for home buyers/sellers who wish to relocate as they are “travelling home” albeit a new home.

In order to further strengthen against any doubt as to why a buyer/seller is relocating it is recommended you retain a signed copy of the Contract of Sale (O&A). A situation where this may be useful is where you are traveling separately from your belongings and may be required to substantiate the travel.

Self Representation.
In Western Australia it is permissible for an individual to represent themselves at settlement as the buyer/seller. In doing so the individual must be the registered proprietor if selling or the buyer as noted on the contract of sale.
Section 26 of the Settlement Agent’s Act states that “A person shall not carry on business, or by any means hold himself or itself out, as a real estate settlement agent”. This extends to
family or friends unless they are a licensed settlement agent, lawyer or as an employee of a licensed settlement agent or lawyer.
The increasing reliance on trained professionals to facilitate settlement is evidenced in both state and federal legislation requiring duty and tax remittance as well as the necessity to undertake enquires with local government authorities and utility providers such as the Water Corporation.
The misguided notion that settlements are easily facilitated by an inexperienced untrained individual exposes all parties to unnecessary risk and potential loss that can result in significant claims for damages.
Individuals who choose to represent themselves or be represented by an unqualified friend or family member not only risk the financial consequences of poor decisions but can be held liable for a range of legislative obligations.
It is also important to note that a maximum of $20,000 penalties can be imposed on individuals acting for family or friends.
