Asset protection is most useful when it is planned before you need it.

Business disputes, creditors, relationship breakdowns and family changes can all affect the assets you've worked hard to build.

Trying to restructure or move assets after a problem has already arisen can have serious consequences.

That's why good estate planning looks at your position early, including your property, business structures, trusts, Super, family circumstances and future beneficiaries.

Planning ahead gives you more opportunity to consider how everything should work together.

In a blended family, you may want to provide for your partner while also making sure your children from a previous relationship receive the inheritance you intended for them.

Simply leaving everything to your surviving partner may not always achieve that outcome.

A surviving partner could later remarry, change their Will or sell property. The assets you hoped would eventually pass to your children may not end up where you intended.

Estate planning can consider structures that provide for your partner while also protecting your children's future inheritance.

For many families, the family home is one of their most important assets. In a blended family, how that home is owned can become especially important.

In NSW, property is commonly held as either joint tenants or tenants in common.

With joint tenancy, a deceased owner's share generally passes automatically to the surviving owner. With tenants in common, each owner holds a defined share, which generally becomes part of their estate.

The way your property is owned can therefore affect what happens after you die, regardless of what your Will says.

Think your Will controls everything you leave behind? Not necessarily.

Your estate plan may also need to consider your property ownership, Super and death benefit nominations, business interests, trust structures and your family circumstances.

For example, jointly owned property may pass automatically to the surviving owner rather than through your Will. Superannuation also does not automatically form part of your estate.

Your Will needs to work together with the rest of your financial and legal arrangements.

Blended families bring so much love, but they can also bring extra complexity when it comes to estate planning. ❤️

You may want to make sure your current partner is secure while also protecting the inheritance you intend for children from a previous relationship. Then there may be a family home, super, a business, trusts or other assets to consider.

A standard Will may not address all of these moving parts. Your Will, property ownership, super nominations and other arrangements need to work together.

Good estate planning isn't about choosing sides. It's about putting the right structures in place for the family you actually have.

The Real Cost of Contesting a Will

When choosing an estate litigation lawyer, look beyond the promise of a fight.

Look for someone who can combine:

- Estate litigation experience
- Understanding of family circumstances
- A genuine focus on resolution
- Clear communication
- Transparency around costs
- Compassion for the people involved

The right lawyer should help you understand whether your matter should be negotiated, mediated or taken further, and why.

At Falzon Legal, the focus is on finding a way through, not simply looking for a fight.

Have You Been Left Out of a Will?

Legal costs shouldn't feel like a mystery.

Before choosing an estate litigation lawyer, ask:

- Is the work fixed fee, hourly or a combination?
- What will the initial stage cost?
- What could cause the costs to increase?
- How and when will you be billed?

Understanding the financial side of your matter can help you make a more informed decision about whether and how to proceed.

📞 Call the team at Falzon Legal to discuss your options and costs.
