The High Court has confirmed that an unpaid present entitlement (UPE) is not a loan for the purposes of Division 7A – bringing further clarity to one of the most closely watched tax issues affecting family trusts and corporate beneficiaries.

While the decision provides certainty on the Division 7A position, the ATO has previously expressed ongoing concern with these arrangements in its interim decision impact statement https://shorturl.at/dKUDq. It also continues to focus on the potential application of section 100A, Part IVA and broader trust reform proposals, including the proposed 30% minimum tax for trust distributions.

This decision is an important reminder to continue reviewing trust structures in light of ongoing regulatory and policy developments.

Our Head of Commercial Services, Malcolm Campbell, recently represented Coleman Greig at the PLG International Lawyers meetings in Milan, hosted by Studio Legale Marsaglia.

The three-day event brought together lawyers from across the PLG network to discuss current legal and business matters and reconnect with colleagues from different jurisdictions. As the only Australian member of the network, Coleman Greig’s involvement provides valuable opportunities for clients with cross‑border interests.

Highlights included a series of sessions led by our hosts, along with the opportunity to experience the culture and atmosphere of Milan.
