Hello! If you’re new here — welcome. I’m so glad you’ve found your way into this space.

It feels like the right time for a little reintroduction with so many new faces around after sharing the brilliant clip presented incorporating a segment which touched upon the benefits of Testamentary Trusts (which, yes — I’m a little obsessed with).

I’m Jaime — mum of five, wife, farm-dweller, and the face behind Family First Estate Planning. Life is full (and often a little chaotic), but this work truly lights me up.

I’ve worked in both family law and estate planning for over 15 years, and what I offer now is high-end legal planning — the kind of advice, strategies, and structures the wealthy have always used — but made more accessible. Everyone deserves the chance to amplify the legacy they leave for their partner, their children, and their beneficiaries.

I believe Testamentary Discretionary Trusts are one of the most powerful and underutilised tools available to families in their planning - along with Binding Financial Agreements (particularly for blended families) who want clarity, fairness, and protection for everyone they love.

It’s top suggestion? A testamentary discretionary trust.

This post might feel a little blunt — but sometimes we need the wake-up call.

Estate planning can feel heavy or “not urgent.” But what if something happened to you tomorrow? Seriously. Sh*t happens and we are all human. Has this been on your mental to do list for 1 year? 2? 3?

If something happened, would family know what to do?
Where would your kids go? Short term and looking further ahead?
Have you protected what you’ve built and set up the right structures for family financial security and support?

Not planning doesn’t protect them — it just delays the heartbreak and multiplies the mess.
Emotionally. Legally. Financially.

Same $1 million. Two very different outcomes.

I know estate planning can feel overwhelming (and sometimes it’s hard to know what actually makes a difference), but this is one of the clearest examples I can give.

If you were to leave $1 million to your spouse and it’s invested at 5% per annum, that’s $50,000 of income each year. If it’s in their personal name, it’s fully taxable and adds to their assessable income—potentially pushing them into a higher tax bracket—even though they’re likely just spending that money on your kids and their living expenses.

With a testamentary trust set up in your will, that same $50,000 can be distributed to your minor children—taxed like adults. That means the first $44,000 per child (as of this year) can be completely tax free.

It’s one of the most effective (and underused) strategies for protecting and preserving your family’s wealth for the next generation. And it costs less than you think to set up properly.

This is exactly the kind of thing I walk through with families in our planning sessions—making sure your legacy is protected and your people are supported long after you’re gone.

I know estate planning can feel overwhelming (and sometimes it’s hard to know what actually makes a difference), but this is one of the clearest examples I can give.
