Imagine this.

You've separated. You've agreed that the family home needs to be sold but now the questions start. Who decides when it's listed? How do you know what it's worth? What happens to the mortgage? Who handles the settlement, and what if you and your former partner don't agree?

There isn't always one simple answer because every situation is different.

Depending on the circumstances, you may need advice from several different professionals throughout the process.

A lawyer can advise on the legal issues. A property valuer may help establish an independent value. A real estate agent can assist with the sale. A mortgage broker may help you understand refinancing or lending options. A conveyancer can assist with settlement once the property is sold or refinanced.

The important part?

Don't assume that one professional has to handle every part of the problem.

If you were in this situation, who would you call first?

A. Lawyer
B. Real Estate Agent
C. Property Valuer
D. Mortgage Broker

You've lived there for years, and you know what you paid for it. You've watched the neighbours sell. You've probably checked an online property estimate more than once. But when property becomes part of a separation, guessing its value may not be enough.

An independent property valuation can help establish what a property is worth based on relevant evidence and the characteristics of the property.

This can be particularly useful when there is disagreement about value or when an accurate figure is needed for broader property discussions.

A property valuer is just one of the professionals who may become part of the process.

The important thing is knowing when specialist advice may be useful.

When a relationship ends, the legal side of things is often only one part of what needs to be worked out. There may be questions about the home, the mortgage, the children, finances, your living arrangements, wellbeing, and suddenly, you may find yourself wondering: Who do I actually need to speak to?

A lawyer may be the right place to start for legal advice, but depending on your circumstances, you may also need support from other professionals along the way. A mortgage broker can help you understand your lending options. A property valuer can help establish what a property may be worth. A conveyancer can assist with settlement after a property sale or refinance. A psychologist or counsellor can provide personal support during a difficult period.

My Family Lawyer Network brings family law-related services together in one place to help you find the right direction.

OLD IDEA: “It Was Made Before, So It Will Just Continue.”

NEW REALITY: The Court Still Needs to Consider the Evidence.

One of the misconceptions surrounding Intervention Orders is that an existing Order will automatically be extended when it reaches its expiry date.

That's not how it works.

An application to extend an Intervention Order still needs to be considered by the Court.

The Applicant needs to establish that continued protection is necessary and that there are reasonable grounds to continue fearing family violence.

The Court can consider the broader circumstances and evidence before it.

In one of our recent cases, Police were initially considering withdrawing their support for an extension. Our lawyers made detailed submissions addressing ongoing risk factors, an outstanding specialist investigation, matters involving children and other relevant evidence.

Police ultimately reserved their position, and the Intervention Order was extended for a further 12 months.

A common misconception is that an Intervention Order will simply be renewed because an Order was previously in place.

It won't automatically happen.

If an Intervention Order is approaching its expiry and you believe ongoing protection is required, an application may need to be made to extend the Order.

The Court will consider the circumstances of the particular case and whether there are reasonable grounds to continue fearing family violence and whether continued protection remains necessary.

Evidence and the circumstances surrounding the matter are important.

Our recent case study demonstrates this.

Police were considering withdrawing their support for an extension, but after detailed submissions addressing the ongoing risk and broader evidence, their position changed.

The Intervention Order was ultimately extended for a further 12 months.

The Order Is Expiring. There Are Still Safety Concerns. What Would You Do?

Imagine this:

A Family Violence Intervention Order is approaching its expiry date.

There are still concerns about future family violence.

A specialist police investigation is ongoing.

There are children involved.

And Police are considering withdrawing their support for an extension.

What happens next?

The answer isn't simply “the Order gets renewed.”

An application to extend the Order needs to be properly presented to the Court, with the relevant evidence and circumstances addressed.

That's exactly what happened in one of our recent matters.

Our lawyers made detailed submissions addressing the ongoing risks and the broader evidentiary picture. Police ultimately reconsidered their position and the matter resolved with the Intervention Order being extended for a further 12 months.

Would you have assumed the Order would automatically continue?

Tell us in the comments: YES or NO?

WHY THESE CASES NEED EXPERIENCE

Our recent case studies show just how different Intervention Order matters can become.

1. Police support can change.
In one matter, Police were considering withdrawing their support for an extension. Detailed submissions ultimately led Police to reserve their position, and the Order was extended for another 12 months.

2. Intervention Orders can intersect with parenting orders.
In another matter, the Court made a Final Intervention Order and exercised its powers under section 68R of the Family Law Act 1975 (Cth) to suspend substantial parts of existing parenting orders.

3. Costs can become an issue.
In a separate Wyndham Magistrates' Court matter, two Family Violence Intervention Order Applications were struck out and the Applicant was ordered to pay each Respondent's legal costs of $1,750.

Three very different matters.

Three very different legal issues.

And one important reminder:

There is no one-size-fits-all approach to an Intervention Order matter.

The appropriate strategy depends on the evidence, circumstances, parties involved and stage of the proceedings.
