A Deed of Family Arrangement can be a great way to resolve estate disputes without going to court.

It gives families more control, can reduce costs, and often helps preserve relationships.

But it’s not a quick fix.

There are real legal and financial implications, especially when it comes to tax, stamp duty, and making sure everyone fully understands what they’re agreeing to.

And if it’s not done properly, it can create more problems than it solves.

Like most things in estate planning, it’s not just about the outcome, it’s about how you get there.

The government sees a tax planning structure.
Everyone else sees a family.

The thing that most people get wrong about the proposed budget 30% tax on testamentary discretionary trusts? The practical outcome is the opposite of what the policy intended.

The wealthy will have a tax neutral outcome but our most vulnerable will have to pay a tax penalty.

The reason most people use a testamentary discretionary trust is not tax minimisation, but for much needed asset protection.

Under the proposed tax, any beneficiary earning less than $45,000 of income from other sources who needs the protection of the trust for their inheritance will be paying a penalty.

The asset protection benefits are so great that wealthy people will still use testamentary discretionary trusts, especially when the tax outcome is neutral.

In a world where everyday Australians rely on their inheritance to get into the housing market, it hardly seems fair.

When people think about estate disputes, they picture court.

Lawyers. Hearings. Long timelines.

But that’s not how most of these matters actually end.

Many are resolved privately, through something called a Deed of Family Arrangement.

It’s where everyone involved agrees to change how the estate is distributed,

👉 without a judge deciding the outcome.

Why do people choose this path?

Because court is:

➡️ Expensive
➡️ Time-consuming
➡️ Emotionally draining

And often, families would rather find a way forward than fight it out.

But it’s not as simple as just “agreeing.”

✔️ Everyone needs to be on board
✔️ The terms need to be properly documented
✔️ And there can be financial consequences if it’s done wrong

So while it can avoid court it still needs to be handled carefully.

Because the goal isn’t just to resolve the dispute, it’s to avoid creating a new one.

Fortnight wrap-up time, and this one has been a busy one. 👀
