Think you need to sign before you're legally bound? Think again.

A recent Supreme Court of Victoria decision has confirmed that an unsigned settlement agreement can still be legally binding.

In Papanastassis v Papanastassis [2026] VSC 302, the Court found that the parties' conduct, communications and objective intention were enough to create an enforceable settlement—even though the deed was never signed by all parties.

Key takeaway: Don't assume you're protected just because no one has signed. What you say and do during negotiations could have legal consequences.

If you're negotiating a settlement or commercial agreement, obtain legal advice early to ensure your rights are protected.
