People diagnosed with dementia or Alzheimer’s disease, in most instances, no longer have the legal capacity to sign legal documents, including a Power of Attorney or a Will. Once a person is deemed not to have legal capacity the guardian, or next of kin, are required to make an application to VCAT for the appointment of a guardian or administrator. This will allow the guardian to make decisions in relation to the day-to-day welfare of their loved ones.
