Today is Safer Internet Day. Here are some tips to stay safe when dealing with IP and business registrations:

⚠ Beware of scams that target trade mark, business name, company name and domain name registrations. Common red-flags are fake urgency, false claims of pending third-party applications, inflated costs, and unexpected correspondence that looks like an invoice. If in doubt, check with your existing service provider, or contact the appropriate government agency.

⚠ For business name registrations, renewals and annual company reviews, use your existing trusted professional (eg accountant or lawyer), or skip the middleman and pay ASIC directly. Never pay an unsolicited third party renewal notice sent in the mail.

⚠ Don't trust cheap online trade mark registration providers. Always engage a qualified, insured and registered IP professional for trade mark applications. Verify your IP professional's registration with your state or territory's law society/institute (for lawyers), or the Trans-Tasman IP Attorneys Board (for trade mark and patent attorneys).

⚠ "Registration" is now targeting the IP Australia trade mark register to send shonky ASIC Annual Company Review solicitations. This mail was sent to the Trade Mark Owner's address (not the Address for Service).

This practice is unethical at best, and in our view constitutes misuse of the public Australian Trade Mark Register database. However, it is not technically a scam so long as "Registration" actually provides the service advertised.

Always use trusted service providers to manage your business names, companies and trade mark registrations. Beware of unexpected requests and "notices" received in the mail or by email, especially if payment is requested.
