If you’re involved in a hit and run, how on earth do you track down the at-fault vehicle?

Finding the at-fault vehicle can be critical, especially if you want to access compensation. At the very least, making genuine attempts to find the at-fault vehicle can be mandatory for certain types of claims.

It's a busy time of year. The roads are congested. You want to edge filter.

Let's make sure ALL road users know the rules.

By educating yourself and others, you can:
- Make sure you're riding lawfully
- Help non-riders understand what riders are allowed to do
- Reduce unnecessary road rage (hopefully)

"What about LANE filtering" you ask? Stay tuned, we'll post about lane filtering next.

"I don't know David, why don't you learn the road rules?" - what we wanted to say.

In all seriousness, education is key. This comment is a perfect example of how little awareness some road users have when it comes to motorcyclists.

As we roll into the holiday season, we'll be posting some of the basics to help everyone stay safe on our busy roads. Stay tuned, and help us spread the knowledge.

Motorcycle Law Queensland was built by people who understand what it's like to be on two wheels. We know the roads, the risks, and the reality of what happens when things go wrong.

That's why we do this. Because riders deserve lawyers who understand the split-second decisions you make, why you take the road you take and what it costs when someone else's carelessness puts you and your bike at risk.

We don't just know motorcycle law. We live it.

When you need someone in your corner, we're the ones who get what it means to be a rider.

You're riding and hit a pothole and now your wheel's damaged. Your bike's out of action. Now what?

Here's what riders often don't know: If the road authority was aware of the pothole and didn't fix it, they can be liable.

To claim against a road authority, you need to prove:

• the pothole was there long enough that the authority should've known
• the road authority should have taken action but they didn’t
• the pothole caused damage to your bike
So, it’s important to get photos of the pothole and your bike, and find out what you can about the history of the pothole.

Roads that aren't maintained properly put riders at real risk.

Need a hand? Send us a message. This is exactly the kind of thing we help riders with.

Can modified bike parts affect your insurance claim?

Potentially!

Bike modifications can potentially impact an insurance claim, depending on:
- Your bike
- The specific modifications
- Your insurance policy
- Whether you’re claiming on your own policy, or claiming against someone else

If you want your own insurance to cover you after an accident, it’s usually best to make sure you tell your insurer about modifications. Some insurers require you to report any modifications, so that the policy can be updated. Failing to do so could mean voiding your coverage.

If you want to make a claim against another person (such as an at-fault driver or their insurer), your modifications are only relevant if they contributed to the accident. If your modifications did not cause the accident (e.g. attaching a saddle bag), they are not relevant. If your modifications did contribute to the accident (such as unlawful lights or signals), then they might make it difficult to bring a claim.

Our suggestions?
1. Update your insurer about any modifications (just in case)
2. Make sure your modifications are safe and roadworthy

If you need help with a claim, get in touch and we’ll help you figure out your next step.

After a traffic incident, it is important to stay calm and take practical steps. If possible, secure the scene and ensure the safety of all involved. Emergency services should be contacted if required.

In Queensland, police must be notified if anyone is injured, if a vehicle requires towing or if a driver fails to provide their details.

Gathering information at the scene may also be useful.

Contact us if you need further information about this.

These processes typically involve steps such as collecting evidence, sending a letter of demand, negotiation and, in some cases, applying to QCAT or commencing court proceedings. Time limits can apply.
