UAE PROBATION: JOIN A NEW EMPLOYER?

Article 9, UAE Labour Law (Federal Decree-Law No. 33 of 2021)

♦️Give 1 Month's Written Notice,If RESIGN during Probation to join another Employer in the UAE.
♦️New Employer May Pay Recruitment Costs:
📍The new Employer may compensate the current Employer for Recruitment/Hiring costs, unless both Employers agree otherwise.

♦️Employee Is Not Personally Liable
📍The Employee is not required to pay Recruitment or Hiring costs simply because resigned.

♦️Employer Cannot Recover Employment Costs from Employee:
📍Visa fees, Work permit fees, Medical Examination fees, Emirates ID costs, and other Recruitment expenses are generally the Employer's responsibility.

🔖Leaving the UAE?
If you are leaving the UAE instead of joining another Employer within the UAE, the compensation rule for the new Employer generally does not apply.

RESIGNATION REFUSED? Know Your Rights

Resignation is generally a unilateral decision. An Employer cannot force an Employee to remain in employment simply by refusing to accept a RESIGNATION, provided the employee complies with the employment contract and applicable UAE labour laws.

Key Steps:
◾Submit RESIGNATION in writing and keep proof of delivery.
◾Clearly state the last working day after completing the required NOTICE period.
◾Continue working throughout the notice period unless it is waived in writing.
◾Keep copies of all Emails, Messages, and Correspondence.
◾If the Employer refuses to process resignation or delays Work permit or Visa cancellation, you may seek assistance from MOHRE.

Remember: Do not stop attending work during the notice period without a written agreement or another lawful reason, as this may create separate Employment issues.

MOHRE Shows"Paid"—No Salary Received?

♦️Verify Bank Account & WPS Payment:
📍Verify Employee’s Bank Account Statement, confirm that NO SALARY was credited.
📍If Employee’s Salary is paid through the Wage Protection System (WPS), ensure that no salary was credited under a Different Transaction Reference or Description.

♦️Request Proof from Employer or HR department to provide:
📍The WPS Salary Transfer Receipt.
📍The Salary Transfer Transaction Reference Number (if available).
📍Confirmation of the Bank Account Number or IBAN to which the salary was transferred.

♦️Collect Supporting Evidence:
📍Bank Statement showing that no salary was received.
📍Employment Contract or Labour Contract.
📍Salary Slip (if issued).
📍Screenshot from the MOHRE App showing the SALARY as "Paid."
📍WhatsApp messages, Emails, or other Communications regarding the unpaid salary.

🚫If Employer fails/refuses to resolve the issue File a Complaint with MOHRE:
🔖Submit a Salary Complaint through the MOHRE App or the MOHRE website.
🔖Or call MOHRE Customer Service: 600 590 000.
🔖Request an Investigation into the WPS payment record and confirmation of whether the Salary was actually Credited.

👁️Remember: Salary marked as "Paid" in MOHRE doesn't always mean it's credited to your bank. If you haven't received it, you have the right to request an official investigation.

UAE LABOUR LAW: PROBATION "0"?

If the official Employment contract shows Probation: "0", it generally means NO PROBATION PERIOD APPLIES, and the Employees are treated as a regular Employee from the start of Employment.

♦️UNDER UAE LABOUR LAW:
📍The Employee can Resign, subject to the Employment CONTRACT..
📍Serve the contractual NOTICE PERIOD (Typically 30–90 days), unless WAIVED by the Employer.
📍The Employer must complete the required Work permit and Visa cancellation or lawful Transfer process, where applicable.
📍The Employer cannot require The Employee to reimburse Visa, Work permit, or Recruitment expenses solely because of resign.

👁️BEFORE RESIGNING, VERIFY THAT:
🔖Employee’s official MOHRE or applicable Free Zone CONTRACT states Probation: "0"; and
🔖There is no separate SIGNED Agreement providing for a PROBATION PERIOD.

UAE Labour Law: Resigning After Probation

♦️Once your 6-month PROBATION period is completed:
📍You can RESIGN and JOIN another Employer.
📍You must serve the NOTICE PERIOD stated in your Employment Contract (Typically 30 days, but it may be 30–90 days).
📍Your Employer must complete the Work permit and Visa Cancellation process, or the lawful transfer procedure if applicable.

♦️Under UAE Labour Law:
📍Your Employer cannot ask you to REPAY Visa or Recruitment expenses just because you RESIGN.
📍Any CONTRACT CLAUSE making you pay costs that the law places on the Employer is generally not ENFORCEABLE.

👁️Always review your Employment contract and ensure your resignation complies with the applicable NOTICE PERIOD and UAE Labour Law.

UAE LABOUR LAW: EMPLOYMENT PROCESS

In the UAE, Employment with a Company generally starts through the following process:
📍JOB OFFER–The Employer issues an OFFER LETTER specifying the Position, Salary, and Employment terms.
📍ACCEPTANCE–The Employee Accepts and Signs the Offer.
📍WORK PERMIT APPROVAL–The Employer obtains the necessary Work Permit from the RELEVANT AUTHORITY.
📍EMPLOYMENT CONTRACT–Both parties SIGN the Official Employment Contract.
📍VISA PROCESSING (for Expatriates)–Medical fitness test, Emirates ID application, and Residence visa procedures are completed.
📍JOINING DUTY–The Employee REPORTS FOR WORK on the Agreed Joining Date.
📍PROBATION PERIOD BEGINS–The Probation Period starts from the date the Employee actually commences work. 📍PAYROLL REGISTRATION–The Employer registers the Employee for salary payment through the appropriate system.

UAE Labour Law: Resignation Without Notice–Consequences

Under Article 43 of UAE Federal Decree-Law No. 33 of 2021, an Employee is generally required to serve the contractual Notice period (minimum 30 days and maximum 90 days) before leaving Employment.

♦️If the Employee resigns and does not serve the required Notice period without a legally VALID reason:
📍The Employer may claim Compensation equivalent to the Employee's salary for the Notice period not served (or the remaining part thereof).
📍The Employer may deduct lawful dues from the Employee's final settlement, subject to UAE Labour Law requirements and applicable procedures.
📍The Employee may face a labour dispute if the Employer files a complaint regarding breach of the Employment contract.
📍End-of-service benefits and other accrued rights remain payable according to law, unless there are lawful Deductions or Court orders affecting the Final settlement.
