Verbal promises can be denied or misunderstood. Written and electronic records provide a stronger basis for proving your rights.
Legal source: Federal Decree-Law No. 35 of 2022 Promulgating the Law of Evidence in Civil and Commercial Transactions
• Article 53 defines electronic evidence as information generated, stored, transmitted or received through information technology, provided it can be retrieved and understood.
• Article 54 recognises electronic records, electronic documents, emails and modern communication methods as forms of electronic evidence. This may include messages exchanged through applications such as WhatsApp, subject to verification.
• Articles 55 and 59 provide that electronic evidence is generally governed by the rules applicable to documentary evidence and may have the evidential value of a private document.
• Article 60 permits electronic evidence to be submitted in its original electronic format or by another electronic method. The court may also request its content in writing.
Therefore, retain complete copies of agreements, invoices, bank transfers, emails, important messages, legal notices and delivery confirmations. Preserve the original conversation or file whenever possible instead of relying solely on screenshots.
The authenticity, integrity and evidential weight of each document remain subject to verification and the court’s assessment.
