إنهاء عقد العمل غير محدد المدة في الإمارات
🔹 يجوز لأي من الطرفين (الموظف أو صاحب العمل) إنهاء عقد العمل غير محدد المدة بشرط:
1️⃣ الإشعار المسبق كتابيًا لمدة لا تقل عن 30 يومًا او وفقًا لما هو منصوص عليه في العقد.
2️⃣ الاستمرار في العمل خلال فترة الإشعار أو دفع بدل عنها في حال عدم الالتزام بها.
🔸 في حالات معينة، يمكن إنهاء العقد فورًا بدون إشعار، مثل:

عدم دفع الراتب خلال 15 يومًا.
وجود خطر جسيم في بيئة العمل.
ارتكاب العامل خطأ جسيم أو تقديم مستندات مزورة.

💰 عند انتهاء العقد، يحق للموظف الحصول على:
أجره عن الفترة التي عمل بها.
بدل الإجازات السنوية غير المستنفذة.
تذكرة العودة في حالة كان الانهاء من طرف صاحب العمل).
مكافأة نهاية الخدمة .

📌 Termination of Unlimited Employment Contract in the UAE
🔹 Either party (the employee or the employer) may terminate an unlimited employment contract provided that:
1️⃣ A written notice is given for no less than 30 days, or as specified in the contract.
2️⃣ The employee continues working during the notice period, or compensates for it in case of non-compliance.
🔸 In certain cases, the contract may be terminated immediately without notice, such as:

Non-payment of salary for more than 15 days
Serious danger in the work environment
Gross misconduct or submission of forged documents

💰 Upon termination, the employee is entitled to:
Salary for the actual working period
Payment for unused annual leave
Return ticket (if termination is from the employer’s side)
End of service gratuity

الحضانة المشتركة تُطبّق إذا اتفق الأب والأم على مشاركة المسؤولية التربوية والرعاية اليومية للأطفال بعد الطلاق، بما يحقق مصلحتهم الفضلى.

👨‍👩‍👧‍👦 يشترط أن يكون هناك تفاهم وتعاون فعلي بين الطرفين، مع ضمان بيئة مستقرة وآمنة للأطفال.

في حال نشوء نزاع، تقيّم المحكمة مصلحة الطفل أولًا، وقد ترفض تطبيق الحضانة المشتركة إذا رأت أنها لا تخدم تلك المصلحة.
