๐๏ธ Off-Plan Property Delayed in Dubai? Know Your Legal Options ๐ฆ๐ช
A property buyer recently asked:
โI purchased an off-plan property in Dubai. The handover date passed years ago, the project is still incomplete, and Iโve already paid 70%. Can I claim compensation or cancel the purchase?โ
This is an important concern for off-plan property investors.
โ๏ธ Dubai off-plan property transactions are subject to specific real estate laws and regulations, including Law No. (13) of 2008, as amended, along with applicable Dubai Land Department requirements.
Depending on the Sale & Purchase Agreement (SPA), project status, registration, reason and extent of the delay, and other circumstances, a purchaser may have legal remedies available. These could potentially include seeking compensation, termination/refund, or other reliefโbut cancellation or compensation is not automatic and requires assessment of the specific case.
๐ Before taking action, check:
โ
The contractual handover date and any extension clauses
โ
The current DLD/RERA project status
โ
Whether the property/project is properly registered
โ
How much you have already paid
โ
The developerโs explanation for the delay
โ
Any notices or revised completion dates you received
โ
Whether you have suffered documented financial loss
๐ Every delayed project is different. Review your SPA and supporting documents before deciding your next step.
